COUNCIL GOALS:

•                     Create and maintain a dynamic team by promoting stability and predictability by providing consistent policy direction.

DISCUSSION:

The Political Reform Act (Government Code Section 81000, et seq.) requires state and local government agencies to adopt and promulgate conflict of interest codes. 2024 is a mandatory review year for all public agencies to review their Conflict-of-Interest Codes, file Biennial Notices with their code-reviewing bodies, and update their Conflict-of-Interest Codes, if necessary.

A Conflict-of-Interest Code designates those employees, members, officers, and consultants who make or participate in the making of decisions which may affect financial interest, who must disclose those interests in financial disclosure statements, and who must disqualify themselves from making or participating in the making of governmental decisions affecting those interests.

On or before July 1, 2024, the City Council, as the City's code-reviewing body, must notify and direct the City Manager to review the City's Conflict-of-Interest Code. The City Manager will have until October 1, 2024, to complete the Code review and file the Biennial Notice with the City Clerk reflecting the results of the review. If a change in the Code is necessitated, an amended Conflict-of-Interest Code will be submitted back to the City Council for adoption (no later than 90 days after the date of filing the Biennial Notice).

Accurate disclosure is essential to monitor whether officials have conflicts of interest and to help ensure public trust in government.

FISCAL IMPACT:

None.

MOTION:

Approve staff recommendation.
