RECOMMENDATION:

Recommendation

Authorize the City Manager to enter into the updated Cooperative Agreement with the San Bernardino County Public Works Department for annual routine maintenance and emergency response projects.

End

COUNCIL GOALS:

•                     Concentrate on Inter-governmental relations by working cooperatively with neighboring jurisdictions.

•                     Invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.

DISCUSSION:

On June 25, 2019, the San Bernardino County Public Works Department (SBCPWD) and the City of Fontana Public Works Department entered into an agreement to provide mutual assistance by utilizing the most effective, efficient, and expedient methods for routine infrastructure maintenance and emergency responses on street segments with shared jurisdictional boundaries. Maintenance of storm drain facilities, post-storm event debris cleanup activities, grading and soil stabilization of unimproved roads, emergency asphalt pavement repairs, pavement markings, and striping are examples of typical projects covered under this agreement.

On June 25, 2024, the agreement was approved by the City Council to extend the agreement.  However, the SBCFWD requested to make minor modifications to the agreement after the City’s approval.

The changes in this updated contract include:

1.                     Section 1.7 allows electronic fund transfers between the City and the County.

2.                     Expiration date was updated to September 30, 2029

3.                     A naming correction to San Bernardino County instead of County of San Bernardino.

4.                     “Not to exceed” was moved in front of $75,000 per project in that title box.

5.                     In 4.11 language was added that the agreement can be signed electronically through DocuSign.

FISCAL IMPACT:

The fiscal impact was previously approved at the June 25th, 2024, council meeting. This updated agreement does not change the previous approved fiscal impact. The approved Funds shall be allocated and available from the Gas Tax (State) Fund # 281 annually in an amount not to exceed $100,000.

MOTION:

Approve staff recommendation.
