RECOMMENDATION:
Recommendation
1. Staff recommends that the City Council approve the MOU between the Fontana Fire Protection District and San Bernardino County Fire Protection District.
2. Authorize the Executive Director of the Fire Protect District, or his designees, to sign and approve the Memorandum of Understanding.

DISCUSSION:
On or about July 10, 2008, the San Bernardino County Fire Protection District (“SBCFPD”) and the Fontana Fire Protection District (“Fontana”) entered into an agreement for fire protection and emergency services for the City of Fontana (“Agreement No. 08-805”). At the end of Agreement No. 08-805 term, on or about July 1, 2018, the parties entered into a subsequent agreement for the aforementioned services (“Agreement 18-354”).
Currently, Agreement 18-354 permits SBCFPD to utilize certain equipment of Fontana outside of Fontana’s limits for a period not to exceed twelve hours in any twenty-four hour period or in a repetitive manner without first obtaining approval from Fontana’s Executive Director or his/her designee. SBCFPD has requested extended use of Fontana’s equipment outside of what is described in Agreement 18-354. Additionally, SBCFPD has requested the use of the Fontana Training Facility Classrooms and resources, once constructed.
Additionally, the parties seek to clarify questions concerning payments made by Fontana to SBCFPD under the Agreements 08-805 and 18-354. This MOU provides clarity of such payments, allows the aforementioned usages and provides payment to Fontana for such uses.
FISCAL IMPACT:
The budgetary impact of the MOU is approximately $24 million over the term of the agreement.
