APPLICANT:

City of Fontana

8353 Sierra Avenue

Fontana, CA  92335

LOCATION:

16000 Dorsey Avenue.  Assessor’s Parcel Number 0232-191-10-0000.

REQUEST:

The Planning Commission determine that the acquisition of the property described herein is consistent with the goals and policies of the City of Fontana General Plan.

PROJECT PLANNER:

Patty Nevins, Director of Planning

BACKGROUND INFORMATION:

Government Code section 65402 (attached) provides that a planning agency of a municipality must report upon whether an acquisition of real property by that municipality is in conformance with the general plan.

PROJECT DESCRIPTION:

The City of Fontana intends to acquire certain real property for rental to low and moderate income households.  The property is located at 16000 Dorsey Avenue (Assessor Parcel Number 0232-191-10-0000).

ANALYSIS:

Government Code section 65402 (attached) provides that a planning agency of a municipality must report upon whether an acquisition of real property by that municipality is in conformance with the general plan.

Acquisition of the subject property by the City’s Housing Department Acquisition, Rehab, and Rental program will enable the Housing Department to provide affordable housing to low- and moderate-income households.

The General Plan land use designation for the subject property is Medium Density Residential (R-M).   The R-M land use category is intended to accommodate single- family detached housing up to 7.6 dwelling units per acre and single-family attached or multi-family housing up to 12 du per acre.  The property’s triplex development is consistent with the Residential Medium Density designation. Furthermore, the acquisition and rental of the subject property is consistent with the City’s Housing goals.

The General Plan’s Land Use, Zoning, and Urban Design element supports a consistency finding for the acquisition of the property.  The project aligns goals with the Land Use, Zoning, and Urban Design element of the General Plan, which states:

•                     Goal #1:  Fontana development patterns support a high quality of life and economic prosperity.

Furthermore, the project aligns with the General Plan’s Housing element, which states:

•                     Goal #1:  Adequate housing to meet the needs of all residents in Fontana.

•                     Goal #2:  A high standard of quality in existing affordable housing stock

California Environmental Quality Act  (“ CEQA”)

The proposed Project is exempt from CEQA pursuant to State CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption). Section 15061(b)(3) of the State CEQA Guidelines states that an activity is covered by the common sense exemption that CEQA only applies to project that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA review. The acquisition of property will not involve nor approve any physical change nor any reasonably foreseeable future change. Therefore, no environmental review is required.

CONCLUSION:

Based on the General Plan goals and policies cited, staff concludes that the acquisition of the subject property is consistent with the City of Fontana General Plan.
