•                     Create and maintain a dynamic team by supporting the decisions of the majority once made.

•                     Create and maintain a dynamic team by promoting stability and predictability by providing consistent policy direction.

DISCUSSION:

The City’s current purchasing practices are governed by both Fontana Municipal Code (FMC) and the Administrative Policy - Purchasing Section 20-50. As a best practice, finance and related policies should be periodically reviewed to ensure that the policies and practices employed are not only in compliance with applicable laws but also to minimize risk, to ensure that the policies mirror actual business practices, and ensure that the procurement of goods and services are conducted in an open and competitive environment.

The Purchasing Policy was last updated in December of 2022, and City staff have conducted a review and have identified areas that need to be updated based on current business practices and the California Public Contract Code (PCC) 22032 that was amended effective January 1, 2025. Notable areas of to be amended include:

•                     Section 3.1.6 Exceptions - Established procurement of professional services and advise in financial, economic, account, legal or administrative matters.

•                     Section 3.2.1 Public Works Projects - Increased the bid limit Pursuant to PCC 22032 from $60,000 to $75,000 negotiated contract and from $200,000 to $220,000 for informal bidding.

The proposed changes will improve the efficiency of the City’s purchasing processes by providing clear and detailed guidance to staff.
