RECOMMENDATION:
Recommendation
1. Award and authorize the City Manager to enter into a Design-Build Contract with McCarthy Building Companies, Inc. for the Downtown West Parking Structure Project in the amount of $20,672,583.00 and authorize a contingency in the amount of $2,067,258.30 (Bid No. DE-24-132-SQ-01).
2. Approve and authorize the City Manager to execute future individual Design-Build Contract Change Orders not exceeding the Contingency amount for the Downtown Parking Structure Project (DE-24-132-SQ-01).
3. Authorize the City Manager to execute any and all utility agreements, utility easement, and any related items on behalf of the City of Fontana for the Downtown West Parking Structure Project (Bid No. DE-24-132-SQ-01).

DISCUSSION:
The City of Fontana’s Capital Improvement Program Budget includes the Downtown West Parking Structure Project (“Project”). The Project is to construct a 5-tier parking structure to include the installation of five hundred one (501) parking stalls. The proposed Project is located within the City of Fontana and is bound by Arrow Blvd. to the south, by Nuevo Ave. to the west, by Spring St. to the north, and by an alley to the east. The intent of the structure is to serve the planned downtown area, also known as the “Forge District”, which will include an office building and hotel to be constructed adjacent to the Project by others at a later date.
On February 1, 2024, the City issued a Request for Qualifications (RFQ) for Design-Build Entities for the Project to seven hundred twenty (720) bidders and fifty-nine (59) downloaded the RFQ. A total of four (4) Statement of Qualifications (SOQ) were received. After evaluation, all four (4) firms were qualified to be invited to the Request for Proposals (RFP) phase. The firms were:
• Bomel Construction Co., Inc.
• Largo Concrete, Inc.
• McCarthy Building Companies, Inc.
• Swinerton Builders
On October 3, 2024, the City issued a Request for Proposals (RFP) for Design-Build Entities to the four (4) firms who met the qualifications. On December 12, 2024, the bids were closed with a total of three (3) proposals received. After the proposal evaluations, McCarthy Building Companies, Inc. was ranked first and invited to a scope and fee refinement meeting.

At the conclusion of the scope and fee refinement process, staff selected McCarthy Building Companies, Inc. for the Design-Build Contract in the amount of $20,672,583.00.
FISCAL IMPACT:
The fiscal impact associated with the approval of this item is $22,739,841.30 for the full term of the contract and included in the 2024-2025 budget as follows: 37600067-601-A-8330 ($15,000,000.00); 37600067-632-A-8330 ($5,672,583.00); and 37600067-632-A-8331 ($2,067,258.30).
