RECOMMENDATION:

Recommendation

1.                     Award and authorize the City Manager to enter into a Professional Services Agreement with Sally Swanson Architects Inc. for the development and implementation of an ADA Self-Evaluation and Transition Plan for City owned facilities the amount of $197,300.00 (Request for Proposals BS-26-61-SP).

 

2.                     Approve and Authorize the City Manager to enter into any future amendments not to exceed 10% contingency in the amount of $19,730.00.

COUNCIL GOALS:

                     Practice sound fiscal management by living within our means while investing in the future.

                     Invest in the City’s infrastructure (facilities, parks, etc.) by maintaining and improving the City’s existing infrastructure.

 

DISCUSSION:

Under Title II of the Americans with Disabilities Act (ADA), public entities are required to complete a self-evaluation of their policies, practices, and services and the effects thereof, to identify and establish a transition plan to correct barriers inconsistent with ADA standards. Public facilities and rights-of-way are required to be accessible to persons with disabilities pursuant to the following statutes: Section 504 of the Rehabilitation Act of 1973 (Section 504) (29 U.S.C. §794) and Title II of the Americans with Disabilities Act of 1990 (ADA) (42 U.S.C.§§ 12131-12164). These statutes prohibit public agencies from discriminating against persons with disabilities by excluding them from services, programs, or activities.

 

The new Self-Evaluation will identify any physical barriers limiting accessibility to and from City buildings and facilities including parks. The plan will provide recommendations for removing identified barriers and complying with accessibility requirements as mandated by the ADA and State of California Access codes.

 

On October 15, 2025, the City issued a Request for Proposals (RFP) for development and implementation of an ADA Self-Evaluation Plan.  On November 16, 2025, proposals were received from two firms interested in providing services for the project. The proposals were evaluated by staff based on firm and staff qualifications, project approach/scope of work, and proposed schedule, in accordance with City policies and procedures. The proposals ranged from $197,300.00 to $254,481.00.

 

Based on the evaluations, staff recommends approval of the Professional Services Agreement with Sally Swanson Architects Inc. due to their experience, available project staffing, schedule, and detailed approach to the project.

 

FISCAL IMPACT:

The fiscal impact associated with the approval of this item is $217,030, including contingencies and is not included in the 2025-26 Current Budget.  Funding for this project is requested in the FY25-26 Mid-Year Budget Report in 10132000-8115.
