RECOMMENDATION:

Recommendation

1.                     Determine the approval of the Agreement and Permit to Enter authorizing temporary access and use of an existing property area for construction staging purposes is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15301 (Existing Facilities) and directs staff to file the notice of exemption.

 

2.                     Approve the Agreement and Permit to Enter with Fontana Courtplace I Housing L.P. Related to Certain Real Property Located at 11196 Sierra Ave, In Fontana, California; and

 

3.                     Authorize the City Manager, or designee, to execute the Agreement and any non-substantive revisions necessary to implement the Agreement.

DISCUSSION:

Fontana Courtplace I Housing L.P (“Permittee”) proposes to develop an affordable housing project, comprising of a two-phased affordable housing community consisting of a total of 106 affordable residential units organized within three court-style residential buildings (“Project”), on approximately 4.8 acres of land in the City of Fontana (“Site”). 

 

In connection with development of the Project, Permittee has requested temporary access to a portion of adjacent City-owned property located at 11196 Sierra Avenue (“City Property”) for construction staging purposes.

 

The proposed Agreement and Permit to Enter (“Agreement”) would authorize Permittee to temporarily enter and use a defined portion of the City’s Property identified in Exhibit “A” to the Agreement (“Licensed Premises”).

 

The Licensed Premises will be used solely for staging construction-related equipment, vehicles, and materials associated with development of the Project. The Agreement establishes the terms and conditions governing the Permittee’s use of the Licensed Premises.

 

ENVIRONMENTAL REVIEW:

The approval of the Agreement and Permit to Enter authorizing temporary access and use of an existing property area for construction staging purposes is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15301 (Existing Facilities), as the action involves only minor temporary use of existing facilities with negligible or no expansion of use. The City Council further finds that none of the exceptions identified in CEQA Guidelines Section 15300.2 apply to the Project or approval of the Agreement and Permit to Enter.

 

The City Council hereby directs staff to prepare and file a Notice of Exemption.

 

FISCAL IMPACT:

No fiscal impact.
