Recommendation
1. Approve and authorize the City Manager to execute a Cooperative Agreement for the Pavement Rehabilitation Project on Maple Avenue between Baseline Avenue and Miller Avenue
2. Authorize the City Manager to execute any future amendments to the Cooperative Agreement for the Pavement Rehabilitation Project on Maple Avenue between Baseline Avenue and Miller Avenue.

DISCUSSION:
The City of Rialto initiated a pavement rehabilitation project at various streets within the City of Rialto. One of the streets is Maple Avenue between Baseline Avenue and Miller Avenue where west half of the street is within the City of Fontana’s jurisdiction. In November 2022, the City of Rialto contacted the City of Fontana’s Engineering Department to request for project funding participation. Engineering staff performed pavement condition evaluation and determined that the street segment will benefit from the proposed rehabilitation project.
The cooperative agreement will define the financial responsibilities for both the City of Fontana and the City of Rialto for the construction of the Project. The City of Rialto will be the lead agency for the design and engineering, utility coordination, and construction of the Project. The total construction cost for the entire project is $18,155,605.28. The City of Fontana will reimburse the City of Fontana’s portion of the construction cost, up to $233,399.00. On February 28, 2023, Council approved Fiscal Year 2022/2023 second quarter budget adjustments which include the Pavement Rehabilitation Project on Maple Avenue between Baseline Avenue and Miller Avenue. The agreement will be approved in counterpart by the City of Rialto on March 14, 2023.
The Project is currently in construction and expected to be completed in November 2023. The City of Fontana’s portion, Maple Avenue, is expected to be completed in April 2023.
FISCAL IMPACT:
The fiscal impact associated with the approval of this item is $233,399.00 and is included in the 2022-23 budget in Project Number 36000053-246-A-8329.
