RECOMMENDATION:

Recommendation

1.                     Authorize the City of Fontana to join the California Joint Powers Insurance Authority (California JPIA) Local Government Liability Reform Coalition; and

 

2.                     Authorize the use of the City's logo on coalition materials by approving the attached authorization form.

COUNCIL GOALS:

                     Practice sound fiscal management by living within our means while investing in the future.

                     Concentrate on Inter-governmental relations by advocating Fontana's position in regional, state, and federal organizations.

 

DISCUSSION:

The California Joint Powers Insurance Authority (California JPIA) has formed a coalition of public agencies to advocate for legislative reforms related to public agency liability. The coalition is seeking meaningful tort reform to help address the increasing costs of civil litigation and liability claims affecting cities and other public agencies throughout California.

 

The coalition supports legislation that would:

 

Establish proportionate liability for economic damages in civil actions against public entities so that public agencies are responsible only for their share of damages; and

 

Establish reasonable caps on damages in civil actions against public entities while ensuring injured parties are fairly compensated and public agencies can continue providing essential public services.

 

Participation in the coalition demonstrates the City's support for these legislative efforts. Approval of the attached authorization form will also allow the California JPIA to include the City of Fontana's logo on coalition materials.

 

FISCAL IMPACT:

There is no fiscal impact associated with joining the coalition.
