RECOMMENDATION:
Recommendation
1. Accept as complete the street and sewer improvements for Tract No. 20546, located along Valencia Avenue between Oleander Avenue and Cypress Avenue.
2. Adopt Resolution No. 2026-055, accepting sewer on Valencia Avenue for Tract No. 20546 as part of the City sewer system.

COUNCIL GOALS:

• To invest in the city’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.
DISCUSSION:
Cyrus Opportunity Zone Fund II, LP constructed street and sewer improvements on Valencia Avenue, a street that provides access to Tract No. 20546. The subdivision is located along Valencia Avenue between Oleander Avenue and Cypress Avenue.
The street and sewer improvements on Valencia Avenue are now complete and acceptance by the City Council is required pursuant to Fontana Municipal Code, Section 26-184(b). Tract No. 20546 is a private community and the internal improvements are not a part of this action.
The street and sewer improvements have been completed to the satisfaction of the Department of Public Works/Engineering. By accepting the improvements as complete, the City will be taking over the maintenance of these improvements.
This action will also authorize the release of the cash deposit, which was posted in lieu of bonds to guarantee performance of the Subdivision Agreement. The applicable portions of the cash deposit will be released as follows: the performance portion upon approval, the labor and materials portion after six (6) months, and the warranty portion after twelve (12) months, less the total of any claims received. The street and sewer improvements have met all Conditions of Approval and the improvements were inspected by the Department of Engineering.
FISCAL IMPACT:
As part of the action to accept as complete the street and sewer improvements on Valencia Avenue for Tract No. 20546, these improvements will be deemed complete and the City will take over operation and maintenance of this public infrastructure. Appropriate funding for the maintenance work is included in the FY 2025-26 revised budget under the Public Works & Engineering Department, Utilities & Streets Division.
