RECOMMENDATION:

Recommendation

1.                     Approve the Final Map for Tract No. 20580, located between Catawba Avenue and Salt Point Way, along Cascade Drive; and accept dedicated right-of-way and easements; and

 

2.                     Authorize the City Manager to enter into a Subdvision Improvement Agreement with the subdivider; and

 

3.                     Approve and authorize the City Manager to execute a Private Street Maintenance Covenant and Agremeent with RC Homes (Glen at Fontana Borrower, LLC) for a portion of Cascade Drive within Tract No. 20580, as required by Condition No. 27 of the previously adopted Conditions of Approval for Master Case No. 22-128, Tentative Tract Map 20580 (TTM22-000008), and Design Review No. 22-059.

COUNCIL GOALS:

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.

 

DISCUSSION:

Tract No. 20580 is located between Catawba Avenue and Salt Point Way, along Cascade Drive.  The project consists of forty-eight (48) detached single-family residences, including four (4) affordable residences, a recreation area, and associated improvements on a 6.8 gross acres site.

 

The Tentative Tract Map No. 20580 (TTM22-000008) was approved by the Planning Commission on September 5, 2023.  All conditions precedent to submitting the final map have been completed by the applicant.  The subdivider, RC Homes (Glen at Fontana Borrower, LLC), has complied with all the Conditions of Approval and has dedicated the required right-of-way and easements as part of the project.  The tract map has been reviewed by the City Engineer and is found to be substantially in conformance to the approved tentative tract map.

 

In addition, an authorization is requested for the City Manager to enter into a Subdivision Improvement Agreement with the subdivider to guarantee the completion of required infrastructure in accordance with the Subdivision Map Act. 

Furthermore, an authorization is required for the City Manager to enter into a Private Street Maintenance Covenant and Agreement with RC Homes (Glen at Fontana Borrower, LLC) for a portion of Cascade Drive within Tract No. 20580.  This agreement is required by Condition No. 27 of the previously adopted Conditions of Approval for Master Case No. 22-128, Tentative Tract Map 20580 (TTM22-000008), and Design Review No. 22-059.

This agreement ensures the proper long-term maintenance of the privately owned portion of Cascade Drive, which includes an easement dedicated to the City for public access.  The Developer is responsible for all associated costs. This protects the City from future maintenance liabilities and ensures continued public upkeep and accessibility of the subject roadway.

 

FISCAL IMPACT:

This action will only approve the tract map for recordation and authorize permits for the construction of the development, therefore, there is no fiscal impact to City resources at this time.
