Approve and authorize the City Manager to execute Amendment No. 2 to the Common Use Agreement (CUA) 03-299 with San Bernardino County Flood Control District for the Monarch Hills Project.

COUNCIL GOALS:

DISCUSSION:
On February 26, 2019, the City Council approved a project development of 233 proposed single-family homes, 129 detached condominiums and 127 attached condominiums in both Residential Planned Community and proposed medium density zones located at existing Lytle Creek Road starting from Duncan Canyon Road and running northeast through certain real property known as Monarch Hills.
As part of the project, the developer was conditioned to construct a multi-use trail to provide pedestrian connectivity. The developer proposes the multi-use trail alignment to use the San Bernardino County Flood Control District’s maintenance road along the west side of Hawker Crawford Channel, that extends from Duncan Canyon Road northerly to Lytle Creek Road, for an approximate distance of 0.85 Miles. The developer is currently processing a construction permit from the San Bernardino County Flood Control District.
Once the developer constructs the multi-use trail, the City of Fontana will operate and maintain the trail. Since the trail is located within the San Bernardino County Flood Control District’s right of way, the City requires an amendment to the existing Common Use Agreement (CUA) with the San Bernardino County Flood Control District to add the additional segment of the multi-use trail.
The original CUA was approved on January 10, 2017 by the City Council with the San Bernardino Flood Control District which defined the responsibilities for both the San Bernardino County Flood Control District and the City of Fontana for the design, construction and maintenance of the project. Amendment No. 2 identifies the Hawker Crawford Channel within the agreement, as the original CUA only identified the San Sevaine Channel. The amendment does not change the original terms of the CUA and is only meant to properly identify the trail and maintenance responsibilities along the west side of the Hawker Crawford Channel.
FISCAL IMPACT:
No fiscal impact. Funds for this project will be budgeted and driven by the developer of Monarch Hills.
