COUNCIL GOALS:

•                     Improve public safety by increasing operational efficiency, visibility and availability.

•                     Operate in a businesslike manner by correcting problems immediately.

DISCUSSION:

The City has a towing franchise in order to meet the needs of the public and the Police Department when towing services are necessary for motorists occupying the public right-of-way. The terms of the City's Towing Franchise, which is codified in Chapter 29 of the Fontana Code.

The current franchise agreements with current tow companies are expiring in 2026.  In order to maintain continuous and uninterrupted towing contract services for the City, the Purchasing Division prepared a Request for Qualifications for Towing Franchise Service (PD-26-162-SQ). Proposals were received from five (5) companies, and an evaluation was conducted to determine which companies meet the towing franchise requirements.  Accordingly, after eliminating the company that did not meet the minimum qualification requirements, four companies remained for consideration.  Of those four, three demonstrated substantially stronger overall qualifications and evaluation results than the fourth company.

Based upon the evaluation, the three recommended companies are the highest scoring that meet all minimum qualification requirements.  This recommendation provides a reasonable balance between service availability, competition, operational efficiency, and the Police Department’s substantially reduced towing demand.  Selecting the three highest performing qualified companies will maintain adequate towing coverage and efficient allocation of towing workload.

FISCAL IMPACT:

Vehicle Release Fees collected will be credited against the Cost Recovery Amount, which the franchisee must pay to the city. The yearly Cost Recovery Amount and Vehicle Release Fee will be reviewed annually and adjusted accordingly each year as part of the annual adjustments to the User Fee Schedule.  The adjustments will reflect the City's current costs for operating the towing program.  The adjustments would coincide with the annual review of the City's User Fees.

MOTION:

Approve the selection of the three companies for towing franchise.
