Approve and authorize the City Manager to execute Amendment No. 9 to a Professional Services Agreement with David Evans and Associates, Inc. for Engineering Services for the San Sevaine Trail Phase 1, Segment 2 Project (SQ-12-DE-17) in the amount of $379,336.38, for a total contract amount of $1,971,277.70.

DISCUSSION:
The San Sevaine Trail Phase 1, Segment 2 Project is a multi-jurisdictional cooperative effort that will enhance the connectivity for bicyclists and pedestrians between the Pacific Electric Trail and public facilities within the Cities of Fontana and Rancho Cucamonga, such as Etiwanda High School, as well as other future infrastructure improvements. The trail will run parallel to the Etiwanda Creek, a flood control channel owned and operated by the San Bernardino County Flood Control District (SBCFCD). The trail will utilize the existing County maintenance road along the west side of the channel and fills in gaps where a road did not currently exist. The multi-use path begins at the Pacific Electric Trail to the south in the City of Fontana and traverses north under the I-15 and SR-210 freeways to Banyan Street in the City of Rancho Cucamonga. The trail length is 1.25 miles, with 0.3 miles located in the City of Fontana and the remaining 0.95 miles in the City of Rancho Cucamonga.
On December 12, 2023, prior to the start of construction, the City Council approved Amendment No. 8 to the Professional Services Agreement with David Evans and Associates, Inc. (DEA) for construction management support services related to the trail, in the amount of $670,119.00. The Professional Services Agreement for Design Services with DEA was approved with an amount of $921,822.32, bringing the total authorized contract amount to $1,591,941.32 prior to construction beginning. Construction commenced in May 2024 and continues with full completion by October 2025. During construction, there have been several unforeseen conditions requiring additional construction management support services from DEA, including additional geotechnical testing, observation, reports as required by Caltrans, redesign of walls within Caltrans Right-of-Way as a result of unmarked utilities, landscape redesign and additional signage to meet SBCFCD requirements, and additional Project Management support for the additional services requested. With a requested additional amount of $379,336.38 to complete all required services during construction, the total authorized amount of construction management support services will be $1,049,455.38 and the total contract amount with DEA for both design and construction management support services will be $1,971.277.70.
FISCAL IMPACT:
The fiscal impact associated with the approval of this item is $379,336.38 for the full term of the Agreement and is included in the 2025-2026 budget in 37603345-635-D-8115 (Park Development Funds).
