Adoption of Resolution No. 2026-091, approving an Affordable Housing Density Bonus Agreement with MV HBC, LLC pursuant to California Government Code § 65915 and Fontana Municipal Code Divisions 4 and 25 related to Master Case Number 25-0051, Tentative Tract Map No. 25-0003 (TTM No. 20839) and Design Review No. 25-0002, pursuant to a Categorical Exemption in accordance with CEQA Guidelines Section 15332 for property located at 14907 South Highland Avenue and identified as Assessor Parcel Number 0228-021-07.

DISCUSSION:
On August 18, 2026, the Planning Commission adopted a resolution approving Master Case No. 25-0051, TTM No. 25-0003 (TTM No. 20839), and Design Review (DRP) No. 25-0002, to subdivide approximately 3.5 acres into forty-six parcels for the construction of 46 residential units, including a density bonus for two (2) affordable residences along with associated site improvements, and recommended that the City Council approve the Affordable Housing Density Bonus Agreement and Declaration of Covenants, Conditions, & Restrictions. Subsequently, the applicant requested relocation of one of the affordable units within the project area. As there was no change to the plan type nor to the number of affordable units, staff concurs with the request and the new location is reflected in the current agreement.
The applicant requests that the City Council review and approve the Affordable Housing Density Bonus Agreement and Declaration of Covenants, Conditions, & Restrictions for property located at 14907 South Highland Avenue, also identified as Assessor Parcel Number 0228-021-07.
The proposed Regulatory Agreement would restrict the use of two (2) units (the “Affordable Units”) by requiring that the affordable units are rented or sold to very low-income households, which is defined as households with income that does not exceed fifty percent (50%) of the Area Median Income for San Bernardino County. The Affordable Housing Density Bonus Agreement provides that the Affordable Units will be restricted for a term of 55 years if offered as rentals and a term of 45 years if sold. The Regulatory Agreement includes obligations for income verification, preparing of a marketing plan, a right of the City to make referrals for the Affordable Units, and other terms related to ensuring the covenants for the Affordable Units. The project entitlements, as conditioned, do not become effective unless and until the City Council adopts a resolution approving the Affordable Housing Density Bonus Agreement and the Declaration of Covenants, Conditions, and Restrictions.
