RECOMMENDATION:

Staff recommends that the Planning Commission consider the location, purpose, and extent of the real property acquisition described herein as required under Government Code Section 65402(c), and adopt Resolution No. PC 2025-016 finding that the real property acquisition is in conformance with the City of Fontana 2018-2025 General Plan, and making CEQA findings pursuant to State CEQA Guidelines Section 15301 and direct staff to file a Notice of Exemption.

REQUEST:

That the Planning Commission determine that the acquisition of the property described herein is consistent with the goals and policies of the City of Fontana General Plan.

BACKGROUND INFORMATION:

Government Code section 65402 (attached) provides that a planning agency of a municipality must report upon whether an acquisition of real property by that municipality is in conformance with the general plan.

 

PROJECT DESCRIPTION:

The City of Fontana intends to acquire certain real property for the purpose of converting the facility into a Regional Navigation Center, which is intended to house chronically homeless individuals in small dormitory style living quarters and individual living units. The property is located at 1109 Jasmine Street (Assessor Parcel Number 0238-111-53).

 

 

ANALYSIS:

Government Code section 65402 (attached) provides that a planning agency of a municipality must report upon whether an acquisition of real property by that municipality is in conformance with the general plan.  Acquisition of the subject property by the City will support the City’s efforts to combat homelessness and aligns with the following goals of the General Plan’s Housing Elemnt:

 

Goal #1: Adequate housing to meet the needs of all residents in Fontana

                     Goal #2:  Fontan development patterns support a high quality of life and economic prosperity.

                     Goal #4: Affirmatively further fair housing in Fontana

 

 

California Environmental Quality Act (“ CEQA”)

The proposed Project is exempt from CEQA pursuant to State CEQA Guidelines Section 15301 (minor alteration to existing facilities as the project includes alterations concerning meeting and office spaces, a reception lobby, commercial kitchen, restrooms, showers/baths, laundry rooms, dining hall, and recreation areas.   Further, none of the exceptions in CEQA Guidelines section 10300.3 apply.  Therefore, no environmental review is required.  hat have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA review. The acquisition of property will not involve nor approve any

physical change nor any reasonably foreseeable future change. Therefore, no environmental review is required.

 

CONCLUSION:

Based on the General Plan goals and policies cited, staff recommends that the Planning Commission determine that the acquisition of the subject property is in conformance with the City of Fontana General Plan.

 

 

MOTION:

Approve staff’s recommendation
