COUNCIL GOALS:

• Concentrate on Inter-governmental relations by establishing partnerships and positive working relationships with other public agencies providing services to residents and local businesses.
DISCUSSION:
The City, along with 15 other cities, entered into the Waste Disposal Agreement (WDA) with the County in 1998. The Agreement commits the City to deliver municipal solid waste generated within its boundaries to the County Landfill System. In return for the City's commitment, the County provides a stable disposal rate for the term of the Agreement.
The current Agreement expires on June 30, 2026. The County is proposing Amendment No. 9 to extend the Agreement through June 30, 2035, and revise the disposal rate structure. Both the City and County recognize that the WDA better serves the public health, safety, and welfare by providing greater disposal rate stability, more predictable and reliable long-term solid waste disposal service, and the continuation of sound environmental management.
The proposed amendment provides the following changes to the WDA:
• Extends the term of the Agreement nine (9) years through June 30, 2035
• Establishes the WDA Contract Rate at 83 percent of the County's posted gate rate effective July 1, 2026, and each July 1 thereafter during the term of the Agreement.
• Eliminates the annual adjustment provision previously included in the Agreement
• Removes the City's convenience termination option for the remainder of the Agreement term.
Rate:
Effective July 1, 2026, the WDA Contract Rate will be established at 83 percent of the County's posted gate rate. Based on the County's Fiscal Year 2026-27 posted gate rate of $49.49 per ton (exclusive of the $12.00 County Disposal System Development Program fee), the resulting WDA Contract Rate will be $41.08 per ton. This rate structure provides a predictable methodology for future disposal costs while maintaining a discounted rate for participating WDA member agencies.
Approval of Amendment No. 9 will allow the City to continue participating in the County's landfill system under the revised rate structure and extended term.
FISCAL IMPACT:
Approval of Amendment No. 9 is not anticipated to result in a direct fiscal impact to the General Fund. Disposal costs associated with municipal solid waste services are incorporated into the City's solid waste rate structure.
