Recommendation
1. Approve the Non-Competitive Proposal purchase under the Purchasing Policies 3.1.5 for Single Source/Sole Source method.
2. Approve a contract in the amount of $180,180.00 with Active Education to support physical education component for the Fontana Expanded Learning Program’s school sites.
3. Authorize the City Manager to enter into the agreement and any future amendments.

DISCUSSION:
Background Summary
The City of Fontana is currently in its eighteenth year of collaboration with the Fontana Unified School District as the Fontana Expanded Program (FELP) provider. The Fontana Expanded Learning Program is an After School Education and Safety (ASES) grant and Expanded Learning Opportunities Program funded program. The Fontana Expanded Learning Program provides physical education, enrichment lessons, homework support and 21st Century Skill lessons to meet the program requirements as well as align with the districts’ efforts to prepare students to engage their world and make healthy choices.
Recommendation
To support the program’s physical education component at twenty-eight (28) elementary and five (5) middle school sites, the Fontana Expanded Learning Program is recommending to contract with Active Education. Active Education will support the program by providing high quality sports clinics to support the physical development and sportsmanship of FELP participants. Due to the program needs, staff is recommending the City to open a purchase order with Active Education.
This curriculum is unique due to Active Education and is only available through the company that meets grant requirements. Purchasing Policy 3.1.5 allows a sole source purchase when no competitive advantage would be gained from unique services that are only available from one source.
FISCAL IMPACT:
The program is budgeted in the adopted FY 2026/2027 Community Services Department operating budget as designed by the FUSD Operating Agreement. The cost of the curriculum is $180,180 and will be funded from Budget Unit #38624101 in the Fontana Expanded Learning Program Account # 8130.
The City, per the Operating Agreement with the Fontana Unified School District, will be reimbursed in an amount not to exceed $180,180 per year for these services provided to the grant-funded after school program.
