RECOMMENDATION:

Recommendation

1.                       Approve a Purchase and Sale Agreement and Joint Escrow Instructions between the City of Fontana and San Bernardino County Transportation Authority for the acquisition of approximately 6,194 square feet of real property identified as a portion of Assessor’s Parcel Number 0191-291-19-0000, for a purchase price of $111,000, plus escrow costs and related acquisition fees.

2.                       Authorize the City Manager to enter into the Purchase and Sale Agreement and/or any other documents necessary or appropriate to facilitate said purchase on behalf of the City of Fontana.

COUNCIL GOALS:

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.

 

DISCUSSION:

The City of Fontana continues to implement its Downtown Fontana revitalization efforts, including strategic investments in public facilities and infrastructure improvements that support enhanced public services, economic development, and community connectivity. The specific geographic area to be targeted includes Upland Avenue to the North, Orange Way to the South, Mango Avenue to the East, and Juniper Avenue to the West. Implementation of these efforts requires the acquisition, planning, and redevelopment of various properties within this area.

 

To facilitate the implementation of this revitalization, the City established the Metrolink Emergency Responder Substation Project (“Project”) as part of the Capital Improvement Program Budget. The proposed project is within the Fontana Metrolink Transit Center, located at 16855 Orange Way, Fontana, CA 92335 and includes the demolition of the existing public restroom, construction of a new Fontana Police Substation and a café with public restrooms.

 

San Bernardino County Transportation Authority (“SBCTA”) owns the real property, APN 0191-291-19-0000, with a gross area of 223,741 square feet. SBCTA has identified a portion of the parcel as excess property available for acquisition by the City. The proposed Agreement provides for the City’s acquisition of a portion of the parcel consisting of approximately 6,194 square feet which will serve as the site for the proposed Project improvements.

 

Under the Agreement, the City will purchase the Property in fee simple for $111,000, subject to customary escrow, title, and closing conditions.

 

As part of this transaction, the Agreement includes conditions associated with the future use of the property, including continued availability of restroom facilities for SBCTA and its invitees, and maintenance of a police station or substation on the property consistent with the Project use.

 

The purchase price of $111,000 reflects the fair market value appraised by a certified appraiser and concurred by SBCTA. Closing costs are allocated consistent with customary public agency transactions.

 

Approval of the Agreement will authorize the City Manager to enter into the Agreement and related documents necessary to complete the acquisition.

 

FISCAL IMPACT:

The fiscal impact associated with the approval of this item is estimated to be $111,000, plus applicable escrow, acquisition, legal and acquisition related expenses. The necessary budget is included in the 2026-2027 budget in the Capital Improvements Fund #601 in 37600085-601-A-8310.
