Recommendation
1. Approve Agreement Amendment No. 1 with the City of Fontana and San Bernardino City Animal Sheltering Services Contract.
2. Authorize the City Manager to enter into any and all future contract amendments on behalf of the City of Fontana.

DISCUSSION:
The original animal service contract between City of Fontana and the City of San Bernardino was approved April 30, 2024 for a three year contract July 2024 - June 2027. The contract included cost for the animal shelter site improvement and animal shelter services provided for intake of animals.
City of San Bernardino has evaluated the last two years of operation and have proposed Amendment No. 1 to update cost allocation structure based on data collected. Under the new proposal, City of Fontana’s original 24% shared cost will decrease to 12.8%. The restructuring of cost would include direct operational costs, shared operational costs, indirect administrative cost, and a 3% Consumer Price Index (CPI) adjusted to the final year-end reconciliation (true-up) billing. The proposed amendment is attached with details. Staff recommends approving this amendment to utilize the City of San Bernardino for animal sheltering services for the remainder contract year July 1, 2026 - June 30, 2027.
FISCAL IMPACT:
The original contract anticipated an annual fiscal impact of approximately $647,916 on animal shelter services. However, actual cost in the first year totaled $764,954.62. The City is currently in the second year of the contract, with projected costs expected to exceed $780,000.
Amendment No. 1 proposes a reduced cost-sharing percentage for the City of Fontana for year three but also introduces additional administrative charges that were not included in the original agreement. As a result of the changes, year three contract per Amendment No. 1 is estimated at $705,865.08, representing an increase of over $57,000 compared to the original contract estimate but less than actual cost incurred in first year. This amount remains subject to change based on actual animal shelter service usage throughout the year.
Funding for the animal sheltering services is included in the approved departmental budget fiscal year 2026/2027. However, should service demands exceed budgeted amounts, additional funding may be requested through the appropriate budget adjustment process.
