RECOMMENDATION:

Planning Commission of the City of Fontana adopt Resolution No. 2026-012 Determining that the Acquisition of Certain Real Property Identified as Assessor Parcel Numbers 1100-111-51 and 1100-091-71 is in Conformance with the City of Fontana 2015-2035 General Plan and make CEQA findings pursuant to State CEQA Guidelines Section 15061(b)(3) and direct staff to file a Notice of Exemption.

REQUEST:

That the Planning Commission determine that the acquisition of the property described herein is consistent with the goals and policies of the City of Fontana General Plan.

BACKGROUND INFORMATION:

Government Code section 65402 (attached) provides that a planning agency of a municipality must report upon whether an acquisition of real property by that municipality is in conformance with the general plan.

 

PROJECT DESCRIPTION:

The City of Fontana intends to acquire certain real property identified as Assessor Parcel Numbers 1100-111-51 and 1100-091-71 (the “Subject Property”).

 

ANALYSIS:

The proposed acquisition of the Subject Property for open space purposes and supportive uses, including parks and parking, is consistent with the City’s General Plan.

 

Chapter 7 (Conservation, Open Space, Parks and Trails) emphasizes the importance of preserving open space, expanding recreational opportunities, and ensuring that residents have access to well-maintained parks and open spaces. The proposed acquisition supports these goals by preserving land for open space, enhancing opportunities for nature-based recreation and contributing to the City’s broader system of parks.

 

In addition, the inclusion of supportive parking improvements is consistent with Chapter 9 (Community, Mobility, and Circulation) which promotes a balanced , multi-modal transportation network and the provision of parking facilities that support access to community destinations. The proposed project will facilitate convenient access to community destinations, including parks and open space.

 

Based on the foregoing, the proposed acquisition, including its location, purpose and extent is in conformance with the City’s General Plan pursuant to Government Code section 65402.

 

California Environmental Quality Act (“CEQA”)

 

The proposed project is exempt from CEQA pursuant to State CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption). Section 15061(b)(3) of the State CEQA Guidelines states that an activity is covered by the common sense exemption that CEQA only applies to project that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA review. The acquisition of the property for the purpose of open space supportive uses and will not involve nor approve any physical change nor any reasonably foreseeable future change. Therefore, no environmental review is required.

 

MOTION:

Approve staff’s recommendation.
