Recommendation
Adopt Resolution No. 2026-020, declaring a portion of certain real property located at 6585 Cherry Avenue a public right-of-way for street and utility purposes and accepting the road into the City’s street system.

COUNCIL GOALS:
• To invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.
• To invest in the City’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.
DISCUSSION:
The City acquired title to a parcel of the certain real property located on 6585 Cherry Avenue within the City of Fontana, County of San Bernardino, commonly known as Assessor Parcel Number 0228-021-46 (“Property”).
The Property will serve as the site for the new Fire Station No. 80, which is essential to providing emergency services and public safety for the growing community. It is located within the Westgate Specific Plan area, which establishes land use and infrastructure improvements necessary to support planned development and enhance traffic circulation. It includes the widening of the roadway and infrastructure improvements along Cherry Avenue to accommodate increased traffic capacity, along with associated public infrastructure such as storm drains, sewer, streetlights, sidewalks, medians, and bike lanes.
The construction of the Fire Station and associated roadway improvements requires the dedication of a portion of the Property as public right-of-way to accommodate the new public roadway and provide public utility access. Pursuant to Section 1806 of the Streets and Highways Code, this right-of-way must be accepted into the City’s street system, and the City has determined that such acceptance is necessary and in public interest.
CEQA:
Consistent with CEQA and the State CEQA Guidelines, an MND was prepared for the Fire Station No. 80 Project. The Planning Commission adopted the MND and approved the MMRP for the Project and based on the CEQA Sections 15162 through 15164, staff has determined that, with regard to the declaration of public right-of-way and acceptance into City street system, none of the criteria requiring a subsequent environmental document have been met and that further environmental analysis is not required. The Planning Commission directed staff to file a Notice of Determination with the San Bernardino County Clerk and the Office of Planning and Research within five (5) working days of approval of the Project.
FISCAL IMPACT:
There is no fiscal impact associated with the approval of this item.
