RECOMMENDATION:
Recommendation
Approve a temporary exemption to Municipal Code Section 20-43 and Purchasing Policy Section 7.0 Surplus Property for the limited purpose of allowing the City Manager to dispose of surplus city property from City Hall in a cost-effective manner prior to demolition, including permitting City employees and members of the public to acquire certain items for reuse at no cost or nominal consideration.

DISCUSSION:
The City is preparing to demolish the existing City Hall building. A third party appraiser has been retained to assess value and remove items considered to have market value for disposition through public auction or other appropriate resale methods.
Following this process, a significant quantity of remaining City property will remain on site, including but not limited to light fixtures, door hardware, office furniture, filing cabinets, chairs, and landscaping materials such as plants. The cost of cataloging, storing, transporting, or disposing of these items through formal surplus processes is expected to exceed their remaining market value.
Municipal Code Section 20-43 prohibits City officers and employees from bidding on, purchasing, or otherwise acquiring City property, whether by purchase or gift. Purchasing Policy Section 7.0 stipulates the methods of disposition of surplus city property. While these provisions are intended to prevent conflicts of interest and misuse of public assets, their strict application in this circumstance would require the City to incur unnecessary costs to dispose of items with minimal or no resale value.
Allowing a specific and temporary exemption to Section 20-43 and Purchasing Policy Section 7.0 will enable the City Manager to dispose of remaining City Hall property in a manner that is fiscally responsible, efficient, and environmentally beneficial. Permitting City staff and members of the public to take certain items for reuse reduces disposal and hauling costs, minimizes waste, and expedites site clearance in advance of demolition.
This exemption is:
• Limited in scope to city property located within or associated with City Hall
• Temporary in duration, terminating upon demolition of the building
• Discretionary, with authority vested solely in the City Manager
• Non-precedential, applying only to this specific circumstance
High-value items will continue to be disposed of through auction or other appropriate means, and no items will be transferred in a manner that confers preferential treatment or financial benefit beyond nominal value.
FISCAL IMPACT:
The fiscal impact associated with the approval of this item will result in no cost to the City but savings will be realized in both disposal and hauling costs.
