RECOMMENDATION:

Recommendation

1.                     Adopt Resolution No. 2026-010, approving the Purchase and Sale Agreement with the County of San Bernardino, for city owned land located at 11109 Jasmine Street more specifically described as APN 0238-111-53.

 

2.                     Approve and Authorize the City Manager, or City Manager’s designee, to enter into any required documents, including non-material amendments to the Purchase and Sale Agreement, required to effectuate said approvals and/or agreement.

COUNCIL GOALS:

                     Practice sound fiscal management by living within our means while investing in the future.

                     Provide a diverse range of housing types and levels of affordability while addressing homelessness in the community by address Homelessness through proactive programs, including the efforts of the COAST and MET teams.

DISCUSSION:

The City of Fontana has identified Homelessness and Homeless prevention as a top priority. To address this need, the City acquired the subject property and retained an architect to prepare plans to effectuate the renovation of the property into a Homeless Navigation Center. The Navigation center, when completed, will provide housing and services for those that are currently, or are risk of becoming, homeless. The West End Navigation Center (WENC), a 200-bed, full-service regional facility will serve western San Bernardino County, with support and participation from the cities of Chino, Chino Hills, Montclair, Ontario, Rancho Cucamonga, Rialto, and Upland. 

 

Sale of the property is conditioned up its operation by the county as a Navigation Center. The operation of the facility shall be governed by an MOU and operating agreement by and between the County and the participating cities. Should any changes be proposed or required for the operation of the facility during the operational period, approval of the City of Fontana, as the host city for the facility, is required. 

 

The City and County have negotiated a Purchase and Sale Agreement to facilitate the sale of APN 0238-111-53.

 

General Terms of Purchase:

                     Purchase Price will be calculated prior to the end of the due diligence period and will include the sum of all third-party consulting expenses paid by the city as well as the cost of acquisition, permitting, and renovation of the property.

                     The County will have 60 days from the opening of escrow to complete its due diligence on the subject property to confirm the suitability and condition of the property.

                     If county is satisfied with its feasibility review the county will deposit and release $2,000,000 as a non-refundable deposit towards the purchase.

                     City must complete renovation within 12 months of the release noted above.

                     City construction responsibility is to convert the space into a 200-bed navigation center with all improvements completed and approved for occupancy, leaving only the installation of furnishings and equipment for the county.

                     Within two weeks of issuance of a Certifcate of Occupancy and confirmation that all is complete, County deposits the remaining required funds for the purchase, closes escrow and takes possession of the building.

 

The Navigation Center represents a regional solution that goes beyond traditional shelters or short-term motel vouchers. It is designed as a low-barrier, housing-focused service hub that reduces barriers, provides stability, and connects people directly to permanent housing.

 

FISCAL IMPACT:

This transaction will result in sale proceeds to the city in the amount of $11,664,510.00 plus all actual incurred third party consulting costs and improvement cost.
