RECOMMENDATION:

Recommendation

Approve and authorize the City Manager to execute the License Agreement with Southern California Edison (SCE) Company for I-15 Logistics (Caprock).

COUNCIL GOALS:

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by focusing on relief of traffic congestion.

 

DISCUSSION:

On June 2, 2020, the City of Fontana Planning Commission approved MCN No. 15-078 and Design Review No. 16-003 to consolidate twelve parcels into two parcels and a remainder parcel, totaling approximately 83 acres for the development of a new commerce building totaling approximately 1,171,788 square feet. To adhere to the conditions of approval, the developer is constructing intersection improvements at Sierra Avenue and Coyote Canyon Road.

 

As part of the construction intersection improvements, the developer must acquire an easement from SCE and obtain California Public Utilities Commission (CPUC) approval for said improvements.  As a result, the duration to acquire said easement/approval may take up to a year.  The developer is requesting that the City enter into a temporary 5-year License Agreement with SCE for an interim road improvement solution.  The interim road improvements would facilitate a safe right-turning movement from Coyote Canyon Road to Sierra Avenue while the ultimate improvements are being constructed.  The developer will pay the cost specified in the License Agreement (SCE Doc. 306332 Att., Contract No. 9.8611) on behalf of the City.

 

FISCAL IMPACT:

There is no fiscal impact associated with the approval of this item.
