Recommendation
Adopt Resolution No. 2026-009, approving an easement and maintenance agreement between the City of Fontana and KB HOME Cal Management Services LLC.

COUNCIL GOALS:
• To invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.
• To invest in the City’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.
DISCUSSION:
In connection with the entitlements for the development of the Residential Property identified in Exhibit A-2 of the Easement and Maintenance Agreement between the City of Fontana and KB HOME Cal Management Services LLC, the City has required KB HOME Cal Management Services LLC (“Owner”) to assume specific construction and maintenance responsibilities within City-Owned property.
The proposed agreement (“Agreement”) establishes a temporary construction easement for an access road and public trail, and a perpetual maintenance easement for landscaped and native vegetation areas. This Agreement ensures that the construction and ongoing maintenance of these areas are the responsibility of the Owner and subsequently, a homeowner’s association.
CEQA:
Pursuant to Sections 15162 and 15164 of the CEQA Guidelines and Section 8.06 of the City of Fontana’s 2019 Local CEQA Guidelines, an Addendum to the Southridge Village Specific Plan EIR No. 81-3 (SCH No. 81052210) has been prepared for the project. The aforementioned EIR was adopted by the City Council in December 1981 and it anticipated the development of residential units from the project. The FEIR and Addendum support the proposed easement and maintenance agreement and allows for the development of the associated residential units.
FISCAL IMPACT:
There is no fiscal impact to the City’s resources at this time. Maintenance responsibility belongs to KB HOME Cal Management Services LLC and subsequently transferred to a Homeowner’s Association upon its formation.
