RECOMMENDATION:
Recommendation
1. Approve a Purchase and Sale Agreement between the City of Fontana and VRP, Inc., a California Corporation, for the sale of a small portion of real property along Oleander Avenue.
2. Authorize the City Manager to enter into a Purchase and Sale Agreement with VRP, Inc., a California Corporation.

DISCUSSION:
The City of Fontana (“City”) owns a small portion of real property approximately 3,065 square feet along the west side of Oleander Avenue, more particularly described and depicted in Exhibit A. The State of California relinquished the real property to the City per Exhibit A. The City no longer needs the real property of land for street or highway purposes, and it has already been declared exempt surplus per approved Resolution No. 2024-001. The buyer previously made an unsolicited offer to purchase the real property for $7,500.00 based on an Appraisal attached to this report.
The City has negotiated a Puchase and Sales Agreement (“PSA”) with VRP, Inc., a California corporation (“Buyer”), regarding the purchase of the real property along the west side of Oleander Avenue. The City desires to sell the property to Buyer under the terms set forth in the PSA.
Staff has reviewed the terms and conditions of the PSA and determined that the agreement is fair, reasonable, and in the best interest of the City and the public. Staff recommends approval of the PSA to allow the sale of the real property to proceed in accordance with the negotiated terms.
Per Resolution No. 2024-001, staff has determined that the designation of this property as exempt surplus does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3), because it is not a project as defined by the CEQA Guidelines, Section 15378. Adoption of the Resolution does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment.
FISCAL IMPACT:
The sale of the real property will generate $7,500.00 in revenue to the City of Fontana.
