RECOMMENDATION:

Recommendation

Approve Cal OES Form 130, Designation of Applicant's Agent Resolution for Non-State Agencies, designating the City Manager, Deputy City Manager, and Chief Financial Officer as the City's authorized agents to provide required assurances and enter into agreements necessary to obtain Federal and State disaster relief, emergency assistance, and hazard mitigation funding for all open and future disasters and grants for up to three (3) years following the date of approval.

•                     Concentrate on Inter-governmental relations by pursuing financial participation from county, state and federal governments.

 

DISCUSSION:

To be eligible for financial assistance related to a proclaimed disaster, the City must have a current Cal OES Form 130, Designation of Applicant's Agent Resolution for Non-State Agencies, on file with the California Governor's Office of Emergency Services (Cal OES) before any funding is disbursed. The form may be adopted either for a single specified disaster or grant, or as a universal resolution effective for all open and future disasters and grants declared up to three (3) years following the date of approval.

 

The City's existing designation, approved March 25, 2025, remains within its three-year term. Staff is returning to Council to revise the list of designated agents to include the Chief Financial Officer, reflecting the Finance Department's role in disaster cost accounting, reimbursement, and grant closeout. Approval of this form supersedes the prior designation, and disasters and grants declared prior to approval remain covered through closeout under the terms of the applicable designation. Agents are designated by position title rather than by name, which allows the designation to remain valid if an individual leaves the position.

 

The designation applies to Federal and State disaster and mitigation funding, including the FEMA Public Assistance Program, the Hazard Mitigation Grant Program (HMGP), Building Resilient Infrastructure and Communities (BRIC), the Fire Management Assistance Grant Program (FMAG), the Flood Mitigation Assistance Program (FMA), and State assistance under the California Disaster Assistance Act (CDAA). Staff will return to Council for a new designation before the three-year term expires.

 

 

FISCAL IMPACT:

There is no direct fiscal impact associated with adoption of the resolution, and no appropriation is required. Adoption enables the City to apply for Federal disaster and hazard mitigation assistance administered by the Federal Emergency Management Agency (FEMA) and State assistance administered by Cal OES. Any funding awarded, and any associated local cost share, would be addressed at the time of a specific disaster or grant application.
