RECOMMENDATION:
Recommendation
1. Approve a Purchase and Sale Agreement for the purchase of the property near Spring Street facing the Pacific Electric Trail, specifically described as APN 0191-161-25, in the amount of $130,000 plus escrow costs and related acquisition fees.
2. Authorize the City Manager to enter into the Purchase and Sale Agreement and/or any other documents necessary or appropriate to facilitate said purchase on behalf of the City of Fontana.

COUNCIL GOALS:
• To provide a diverse range of housing types and levels of affordability while addressing homelessness in the community by promoting diverse range of housing projects and levels of affordability.
DISCUSSION:
The proposed Agreement for Purchase and Sale and Joint Escrow Instructions is between the San Bernardino County Transportation Authority (“SBCTA”) and the City of Fontana for the acquisition of APN 0191-161-25 (the “Property”). The Property consists of a narrow, unused strip of land located along the south side of the Pacific Electric Trail, between Juniper Avenue and the Pagliuso Chapel garden area.
Under the Agreement, the City will purchase the Property in fee simple for $130,000, subject to customary escrow, title, and closing conditions.
The acquisition of this property will allow the City to consolidate ownership of land adjacent to the Pacific Electric Trail, eliminate an unused parcel and facilitate more orderly development and maintenance of the land by the affordable housing maintenance group.
The purchase price reflects the fair market value appraised by a certified appraiser and concurred by SBCTA. Closing costs are allocated consistent with customary public agency transactions.
Approval of the Agreement will authorize the City Manager to enter into the necessary documents and proceed with escrow to complete the acquisition. The proposed transaction represents a strategic opportunity for the City to secure land needed to implement the City’s housing goals and further the community’s long-term housing strategy.
FISCAL IMPACT:
The fiscal impact associated with the approval of this item is estimated to be $140,000, including escrow costs, acquisition fees, and legal fees. The necessary budget is included in the 2025-2026 budget in the Capital Improvements Fund #602 in 60230000-8310.
