1. Approve and authorize the City Manager to execute the Joint Use Agreement with Southern California Edison Company.

COUNCIL GOALS:
• To invest in the city's infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.
DISCUSSION:
On February 1, 2022, the Fontana Planning Commission approved MCN No. 21-097 for the construction of a 229,019-square foot warehouse building located on the north side of Jurupa Avenue between Mulberry Avenue and Calabash Avenue. To adhere to the conditions of approval, the developer has dedicated public right-of-way to the City for the widening of Jurupa Avenue to the width required by the General Plan and Southwest Industrial Park Specific Plan and will relocate the electrical facilities to be outside the roadway at no cost to the City.
As part of the widening and road dedication process, two privately owned Southern California Edison Company (SCE) easements for electrical facilities adjacent to Jurupa Avenue approximately 300 & 600 feet east of Mulberry Avenue became part of the public right of way. As a result, SCE requested that the City of Fontana enter into a Joint Use Agreement to maintain their existing prior rights for the electrical facilities in their new location. If the City desires in the future to widen Jurupa Avenue further, the City will agree to reimburse SCE for any costs incurred for the relocation of the electrical facilities within the joint use area only as specified in the Joint Use Agreement (Serial No. 73469A, V&LM File No. JUA204239558).
FISCAL IMPACT:
There is no fiscal impact associated with the approval of this item.
