Approve and authorize the City Manager to enter into Landscape Maintenance Easement Deeds with two property owners as part of CFD 115M for the West Valley Logistic Center Project.

COUNCIL GOALS:
• To invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the city's existing infrastructure.
• To invest in the City’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.
DISCUSSION:
On March 26, 2019, the City Council approved Ordinance Nos. 1800, 1801, and 1802 approving Specific Plan Amendment No. 11-003 along with certification of the Final Environmental Impact Report (FEIR) (State Clearing House No. 2012071058) for the West Valley Logistic Specific Plan Project and included approvals for General Plan Amendment No. 11-026 and Zone Change No. 11-016 to redesignate the land use designation of the site to Light Industrial; Development Agreement No. 11-002; and Tentative Parcel Map No. 19156 (TPM No. 13-005) to subdivide the site into nine parcels for the development of the specific plan that anticipated the development of seven (7) industrial commerce center buildings.
On August 16, 2022, the Planning Commission approved Master Case No. 21-072, Revision to Tentative Parcel Map No. 19156 (TPM No. 13-005 R1), and Design Review No. 21-027 and adopted Resolution No. PC 2022-034. Resolution No. PC 2022-034 included Conditions of Approval for Tentative Parcel Map No. 19156. Condition No. 47 required portions of the project to become a part of a Community Facilities District (CFD).
On December 10, 2024, the City Council adopted Resolution No. 2024-137, establishing the City of Fontana Community Facilities District No. 115M and the boundaries thereof. Part of CFD 115M includes a landscaped engineered slope area to the west of Locust Avenue, opposite the intersection with Jurupa Avenue. The construction of the engineered slope is due to the widening of Locust Avenue and the engineered slope is located on two separate private properties that are not a part of Tract Map 19156. Because the maintenance for this landscaped engineered slope will occur on private property, a separate easement is needed for each property to allow the City access to maintain this landscaped area as part of CFD 115M.
The northerly property that is impacted by the landscaped engineered slope is owned by Mr. Marcelino Sanchez and Mr. Wuerner Diaz and comprises of approximately 0.09 acres. The southerly property that is impacted by the landscaped engineered slope is owned by Mr. Timothy Hawke and comprises of approximately 1.2 acres.
FISCAL IMPACT:
There is no fiscal impact associated with the approval of this item.
