RECOMMENDATION:
Recommendation
Adopt Resolution No. 2025-095, to replace and repeal Resolution No. 2025-041 of the City Council of the City of Fontana, California, directing the placement of weed abatement charges on the property tax bills for collection.

COUNCIL GOALS:

DISCUSSION:
On June 24, 2025, the City Council approved Resolution No. 2025-041 directing the placement of weed abatement charges on the property tax rolls. Following this action, the San Bernardino County Auditor/Controller/Treasurer/Tax Collector (ATC) informed the City that additional specifications are now required for placement of direct charges on the FY 2025/26 tax roll.
The County requires that the updated resolution specifically include:
1. Confirmation of governing authorization under applicable state law.
- Pursuant to California Government Code Section 39501 et seq., cities are authorized to require the removal of weeds, rubbish, and refuse, and to recover abatement costs by recording a lien or by placement on the property tax roll.
- The Fontana Municipal Code, Chapter 28 et seq. further establishes the City's authority and procedures for weed abatement, including notice, hearings, and cost recovery.
2. Specific direction to the County ATC to place the direct charges on the current property tax roll.
3. Authorization of the total amount of the charge, including applicable administrative fees.
The revised resolution before Council today satisfies these updated County requirements while reaffirming the City's prior action. The Statement of Weed Abatement Charges, including administrative fees, has been prepared and is attached as Exhibit "A."
This item does not impose any new charges; it simply updates the Council's prior resolution to meet the County's procedural standards for processing
FISCAL IMPACT:
This action ensures timely collection of outstanding weed abatement receivables through the County property tax billing system. The County will apply an administrative charge of $0.30 per parcel. The total amount to be applied for FY 2025/26 is $66,895.20 across 69 properties, which includes administrative costs.
