RECOMMENDATION:

Recommendation

Approve and authorize the City Manager to execute Amendment No. 1 to Task Order No. 2 (DE-24-195-SQ) with Kittelson and Associates in the amount of $56,000 to complete the environmental analysis and documentation to accompany the City’s Truck Routes and General Plan update to be in compliance with AB 98 requirements by January 1, 2026.

 

Approve and authorize the City Manager to execute any future amendments to Task Order No. 2 in the amount not to exceed $30,000.

COUNCIL GOALS:

  • To invest in the City’s infrastructure (streets, sewers, parks, etc.) by focusing on relief of traffic congestion.

DISCUSSION:

Assembly Bill 98 (AB 98) passed into law in September 2024, aiming to reduce the environmental and community impacts of warehouse facilities through regulation of location, design, and operations. AB 98 requires agencies to comply by January 1, 2028; however, agencies deemed to be within a “warehouse concentration region” must comply with AB 98 requirements by January 1, 2026. The City of Fontana was listed as one of the 14 agencies in a warehouse concentration region.

 

To comply with AB 98, the City must update its designated Truck Routes and General Plan prior to January 1, 2026 or risk being fined by the Attorney General up to $50,000 every six months until the updates have been made.

 

Staff released a Request for Proposals (RFP) for consultant services in support of complying with AB 98 to the firms that are on the City’s pre-qualified Engineering List (DE-24-195-SQ) by notifying firms via email. Two (2) proposals were received and reviewed by staff. Based on the submitted proposals and stated qualifications, staff selected Kittelson and Associates, Inc. to provide consultant services in updating the City’s Truck Routes and General Plan to be in compliance with AB 98 requirements by January 1, 2026. A Task Order was issued in April 2025 authorizing them to begin the preliminary analysis needed to determine the level of environmental analysis and documentation that would be necessary prior to completing the General Plan Update. At this point, the level of effort has been determined and the project is ready to complete the CEQA-related environmental analysis and documentation.

 

With the assistance of the consultant, staff will be presenting the proposed updates and changes to the City Planning Commission and City Council for consideration and approval prior to January 1, 2026.

 

FISCAL IMPACT:

The fiscal impact associated with the approval of this item is an increase in expenditures of $56,000 and is included in the FY 2025/26 current budget in Measure I 2010-2040 Local Fund 246, account 24637513-8130.
