RECOMMENDATION:

Recommendation

1.                     Staff recommends that the City Council approve the Sum in Lieu of Utility Undergrounding Deferral and Lien Agreement and Sum in Lieu of Utility Undergrounding Lien with Aman Brar for Assessor Parcel Number 0236-052-47.

 

2.                     Authorize the City Manager, or his designees, to sign and approve the Sum in Lieu of Utility Undergrounding Deferral and Lien Agreement and Sum in Lieu of Utility Undergrounding Lien with Aman Brar for Assessor Parcel Number 0236-052-47.

COUNCIL GOALS:

DISCUSSION:

Fontana Municipal Code (“FMC”) Section 27-52 requires that an applicant applying for a tentative tract map, permit for construction of any new structure or building on undeveloped property, or a permit for substantial rehabilitation of any existing building on an existing lot of record place underground all new, upgraded, or existing on-site or off-site utilities. However, Section 27-54 permits the City’s Community Development Director (now serving as the Development Services Director) to allow an applicant to pay a sum in lieu of undergrounding off-site utilities if the Community Development Director determines that it would be impracticable, infeasible or disproportionately financially burdensome to require the undergrounding of on-site or off-site utilities. Here, the City’s Community Development Director has determined that it would be impracticable, infeasible and disproportionally financially burdensome to require Aman Brar to underground on-site/off-site utilities at the location of 14562 Slover Avenue, Assessor Parcel Number 0236-052-47, and the parties wish to enter into a sum in lieu of utility undergrounding deferral and lien agreement to defer payment and the City will provide a lien against the associated property as security.

 

FISCAL IMPACT:

The fiscal impact associated with the Sum in Lieu of Utility Undergrounding Deferral and Lien Agreement is an increase in revenue of approximately $91,200.00 over the term of the agreement.

 

MOTION:

Approve the Sum in Lieu of Utility Undergrounding Deferral and Lien Agreement and Sum in Lieu of Utility Undergrounding Lien.
