SUBJECT:

Acceptance of Final Parcel Map No. 20464 for the Development of a Commercial Property at the northwest corner of Citrus Avenue and South Highland Avenue, and the Abandonment of a Certain Portion of Alleys and a Certain Portion of Highland Avenue

 

RECOMMENDATION:

 

1.                     Approve Final Parcel Map No. 20464, located on the north side of South Highland Avenue between Citrus Avenue and Catawba Avenue.

2.                     Accept dedication of public streets and easements.

3.                     Authorize the Mayor and City Clerk to certify the abandonment of a certain portion of the alleys and a certain portion of Highland Avenue, as identified on the parcel map.

 

 

 

COUNCIL GOALS:

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by maintaining and improving the City’s existing infrastructure.

                     To invest in the City’s infrastructure (streets, sewers, parks, etc.) by providing for the development of new infrastructure.

                     To help establish and expand economic development within the City.

 

DISCUSSION:

On January 17, 2023, the City of Fontana Planning Commission approved Tentative Parcel Map No. 20464 (TPM No. 20-021), Variance No. 22-001, Conditional Use Permit No. 20-025, Conditional Use Permit No. 22-019, Conditional Use Permit No. 22-028, and Design Review No. 20-031 for the development of a commercial retail center on an approximately 8.9 adjusted gross acre site. The subdivider, Citrus Development, LLC, has complied with the Conditions of Approval and dedicated the required right-of-way and easements as a part of the project. The Parcel Map has been reviewed by the City Engineer and found to be substantially in conformance with the approved tentative parcel map.

 

As a part of this Parcel Map, portions of excess road right-of-way on Highland Avenue and certain alleys are no longer needed and will be vacated and abandoned. Pursuant to Section 66434(g) and Section 66499.20.2 of the Government Code (Subdivision Map Act), the City Clerk must certify the abandonment of those certain portions of street right-of-way. The filing of this Parcel Map shall constitute an abandonment of those portions of the easements granted to the City of Fontana for street and public utility purposes.

 

On May 6, 2025, the City of Fontana Planning Commission adopted Resolution No. PC 2025-013, finding that the vacation and disposition of portions of Highland Avenue and an unnamed alley are consistent with the goals and policies of the City of Fontana General Plan and the project is exempt from CEQA.

 

In accordance with the Subdivision Map Act, the Parcel Map is now being brought to the City Council for final approval.

 

FISCAL IMPACT:

This action will only approve the parcel map for recordation and authorize permits for the construction of the development, therefore, there is no fiscal impact to City resources at this time.
