RECOMMENDATION:
Planning Commission of the City of Fontana adopt Resolution No. PC 2025-038 Determining that the Acquisition of Certain Real Property Located at 16565 Orange Way is in Conformance with the City of Fontana 2015-2035 General Plan, and make CEQA findings pursuant to State CEQA Guidelines Section 15301 and Directing Staff to File a Notice of Exemption.

REQUEST:

BACKGROUND INFORMATION:
Government Code section 65402 (attached) provides that a planning agency of a municipality must report upon whether an acquisition of real property by that municipality is in conformance with the general plan.
PROJECT DESCRIPTION:
The City of Fontana intends to acquire certain real property located at 16565 Orange Way (Assessor’s Parcel Number 0191-251-25) (the “Subject Property”) for the expansion of its Public Works Yard. This facility will serve as a location for the maintenance and storage of equipment, materials, and vehicles essential for providing public services.
ANALYSIS:
The proposed acquisition of the Subject Property will further support the City’s growth by providing much needed space for storage capacity for all city divisions as well as long term expansion opportunities for the public works yard. The acquisition is consistent with the objectives of the General Plan, particularly the following two goals from Chapter 8:
• Goal 3: Fontana has modern, well-maintained public facilities that meet the needs of residents of all ages, businesses, and government.
• Goal 5: New community centers, parks, and facilities are located in the context of multimodal networks for maximum accessibility.
California Environmental Quality Act (“CEQA”):
Under the California Environmental Quality Act (“CEQA”) specifically, CEQA Guidelines section 15301 exempts the “operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use.” Here, the acquisition of the Subject Property will be used for the maintenance and storage of equipment, materials, and vehicles essential for providing public services. Therefore, no environmental review is required.
CONCLUSION:
Based on the goals and policies cited in the General Plan, staff recommends that the Planning Commission determines that the acquisition of the Subject Property is consistent with the City of Fontana General Plan.
MOTION:
Approve staff’s recommendation.
